These Terms and Conditions ("Terms") govern your access to and use of the website localbizindia.com and any related pages, features, tools and services (collectively, the "Platform").
The Platform is owned and operated by Mohd Amir Siddiqui, an individual sole proprietor based in New Delhi, India, trading as "Local Biz India" ("Local Biz India", "we", "us" or "our"). "Local Biz India" is a trade name and not a separately incorporated entity.
All correspondence, including legal notices and grievances, must be sent to the email address specified in Clause 20.
By accessing, browsing, registering on, submitting a listing to, or otherwise using the Platform, you confirm that you have read, understood and agreed to be bound by these Terms and by our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree with any part of these Terms, you must stop using the Platform.
These Terms constitute an electronic record under the Information Technology Act, 2000 and the rules made under it, and do not require any physical or digital signature.
Local Biz India is an online business directory and discovery platform. We provide a venue where businesses can publish information about themselves and where Visitors can search for and view that information.
You expressly acknowledge and agree that:
You may use the Platform only if you are at least 18 years of age and competent to contract under the Indian Contract Act, 1872. If you use the Platform on behalf of a business or organisation, you represent that you are authorised to bind that entity to these Terms, and "you" refers to both you and that entity.
We do not knowingly permit persons below 18 years of age to create accounts or submit Listings. If we learn that a registered account belongs to a minor, we may suspend or delete it.
To submit or manage a Listing, you must create an account and provide accurate, current and complete information.
You agree to:
You are responsible for all activity that occurs under your account. We are not liable for any loss arising from unauthorised use of your account, whether or not you notified us.
We may refuse registration, suspend an account, or terminate an account at our discretion, including where we reasonably believe that these Terms have been breached, that the account is duplicate or fraudulent, or that continued access poses a risk to the Platform or other Users.
Business Users may submit Listings free of charge, subject to these Terms and to any submission guidelines published on the Platform. Submission does not guarantee publication. We may review, approve, reject, edit, categorise, reformat, relocate or decline any Listing at our sole discretion and without obligation to give reasons.
By submitting a Listing, you represent and warrant that:
You are responsible for keeping your Listing accurate. If your business closes, relocates, changes ownership, or ceases to hold a required licence, you must update or request removal of the Listing promptly.
We may modify, suspend, unpublish or delete any Listing at any time, including where it is inaccurate, duplicated, abandoned, unlawful, the subject of a valid complaint, or otherwise in breach of these Terms.
The Platform may allow a business owner to claim an existing Listing. We may require documentary proof of ownership or authority, such as registration certificates, GST details, utility bills, or verification by telephone, email or post. We may accept or reject a claim at our discretion and may reverse a claim if the supporting information proves to be false. Verification checks are limited in scope and do not amount to an audit or endorsement of the business.
By submitting a Listing or any other User Content, you grant Local Biz India a non-exclusive, worldwide, royalty-free, sub-licensable and transferable licence to host, store, reproduce, adapt, format, translate, publish, display, distribute and promote that content on and in connection with the Platform, including in search results, category pages, city pages, email newsletters, social media posts and promotional material. This licence continues for as long as the content remains on the Platform and, for archival, backup, cached and legal-compliance copies, for a reasonable period thereafter.
You retain ownership of your content. You waive any moral rights you may have to the extent permitted by law, so that we may format and display your content as needed.
Reviews and ratings must reflect a genuine, first-hand experience with the business concerned. You must not:
We do not pre-screen all User Content. We may, but are not obliged to, review, moderate, edit, refuse to publish, or remove User Content at any time. We may also aggregate ratings and display average scores, review counts and derived rankings.
We are not responsible for the content, accuracy or opinions expressed in User Content. Reviews reflect the views of the individual reviewer, not of Local Biz India.
Where the Platform allows a Business User to respond to reviews, responses must be professional and must not disclose a reviewer's private information or threaten a reviewer.
You must not, and must not permit others to:
Listings on the Platform are currently offered free of charge. The Platform does not presently process payments online.
Where a business is displayed as "Featured", this reflects an editorial or promotional selection made by us. It does not indicate that the business has been independently audited, certified or endorsed by us.
We may in future introduce paid services such as featured placement, priority positioning, banner advertising or enhanced profiles. If we do:
Any advertising or promotional arrangement agreed privately by email or other correspondence is governed by the terms of that correspondence, read together with these Terms.
The Platform contains links to third-party websites, business websites, maps, social media profiles, payment gateways, analytics services and advertisements. We do not control, endorse, monitor or assume responsibility for third-party content, products, services, policies or practices. Accessing third-party sites is at your own risk and subject to their terms and privacy policies.
Any dealing between you and a third party found through the Platform, including any payment, delivery, warranty, refund or dispute, is solely between you and that third party.
The Platform, including its name, logo, design, layout, user interface, graphics, compilations, database structure, software and all content other than User Content, is owned by or licensed to Local Biz India and is protected by Indian and international intellectual property laws.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform for your personal or internal business purposes. All rights not expressly granted are reserved.
You may not reproduce, republish, distribute, sell, licence, frame, mirror, or create derivative works from any part of the Platform without our prior written consent.
Business names, logos and trade marks appearing in Listings remain the property of their respective owners and are displayed for identification and directory purposes only.
If you believe that content on the Platform infringes your intellectual property rights, or is otherwise unlawful, defamatory or inaccurate, write to our Grievance Officer (Clause 20) with:
We will acknowledge complaints and act on them in accordance with the timelines prescribed under the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021. We may remove or disable access to the content complained of, and may notify the User who posted it.
We may terminate the accounts of Users who repeatedly infringe the rights of others.
Our collection, use, storage, disclosure and processing of personal data is described in our Privacy Policy, which forms part of these Terms and is issued in accordance with the Digital Personal Data Protection Act, 2023 and applicable rules.
If you submit personal data belonging to another individual, including staff contact details in a Listing, you confirm that you have obtained the necessary consent and authority to do so and that such publication is lawful.
Contact details published in Listings are made available so that Visitors may contact the business. They must not be extracted or used for bulk marketing, telemarketing or resale.
We aim to keep the Platform available but do not guarantee uninterrupted or error-free operation. Access may be suspended, withdrawn or restricted for maintenance, upgrades, security, or reasons beyond our control, with or without notice.
We may add, alter, suspend or discontinue any feature, category, city, listing format or service at any time. We may also modify how Listings are ranked, sorted or displayed.
To the maximum extent permitted by law:
You are solely responsible for verifying the credentials, licences and suitability of any business before engaging with it, and for exercising ordinary caution in all dealings.
To the maximum extent permitted by law, Local Biz India, its directors, partners, officers, employees, agents and affiliates shall not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, business, goodwill, opportunity, data or anticipated savings, arising out of or in connection with your use of, or inability to use, the Platform, whether based in contract, tort, negligence, strict liability or otherwise, even if advised of the possibility of such loss.
Without limiting the above, we shall not be liable for:
Where liability cannot lawfully be excluded, our total aggregate liability to you in respect of all claims arising in any twelve-month period shall not exceed the greater of (a) the total amount actually paid by you to us for paid services during that period, or (b) INR 1,000 (Rupees One Thousand only).
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable Indian law, including liability for fraud or for death or personal injury caused by negligence.
You agree to indemnify, defend and hold harmless Local Biz India, its directors, partners, officers, employees, agents and affiliates from and against all claims, demands, actions, proceedings, losses, liabilities, damages, costs and expenses (including reasonable legal fees) arising out of or relating to:
This obligation survives termination of your account and of these Terms.
We may suspend or terminate your access to the Platform, remove your Listing, or delete your account, with or without notice, if:
You may stop using the Platform at any time and may request deletion of your account and Listing by writing to contact@localbizindia.com. Some content, such as reviews you have written or cached and archived copies, may remain on the Platform or in backups after account deletion, subject to applicable law.
Clauses relating to intellectual property, disclaimers, limitation of liability, indemnity, governing law and dispute resolution survive termination.
You must comply with all applicable Indian laws when using the Platform, including the Information Technology Act, 2000, the Consumer Protection Act, 2019 and the Consumer Protection (E-Commerce) Rules, 2020 where relevant, the Digital Personal Data Protection Act, 2023, and any sector-specific advertising or licensing rules applicable to your business.
We may disclose User information and content to law enforcement, regulatory or judicial authorities where required by law, court order, or lawful request, or where we believe in good faith that disclosure is necessary to protect our rights, the safety of any person, or to investigate fraud or a breach of these Terms.

Email is the preferred and fastest channel for raising a grievance.
The Grievance Officer will acknowledge a complaint within twenty-four (24) hours of receipt and endeavour to resolve it within fifteen (15) days, or within such shorter period as the applicable rules require for specific categories of complaint.
Complaints should include your name, contact details, the URL of the content concerned, the nature of the complaint, and any supporting documents.

These Terms are governed by and construed in accordance with the laws of India. Subject to Clause 22, the courts at New Delhi, Delhi shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms or your use of the Platform.
If you have a complaint or dispute, you agree to raise it first with our Grievance Officer under Clause 20 and to allow a period of thirty (30) days from written notice for the matter to be resolved amicably before commencing any formal proceedings.
This clause does not limit any statutory right you may have to approach a consumer forum or other competent authority.
We may revise these Terms at any time. The revised version will be posted on this page with an updated "Last updated" date. Where changes are material, we will make reasonable efforts to notify registered Users by email or through a notice on the Platform.
Your continued use of the Platform after the revised Terms take effect constitutes acceptance of them. If you do not agree, you must stop using the Platform and may request closure of your account.
Entire Agreement. These Terms, together with the Privacy Policy and any order form or supplementary terms for paid services, constitute the entire agreement between you and Local Biz India regarding the Platform, and supersede all prior understandings.
Severability. If any provision is held invalid or unenforceable, that provision shall be modified to the minimum extent necessary or severed, and the remaining provisions shall continue in full force.
No Waiver. Our failure or delay in enforcing any provision shall not constitute a waiver of that or any other provision.
Assignment. You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations to any affiliate or successor in connection with a merger, acquisition or sale of assets.
No Partnership. Nothing in these Terms creates a partnership, joint venture, agency, franchise or employment relationship between you and Local Biz India.
Force Majeure. We shall not be liable for any failure or delay in performance caused by events beyond our reasonable control, including acts of God, natural disasters, epidemics, war, civil unrest, strikes, government action, internet or telecommunications failures, hosting provider outages, cyber-attacks or power failures.
Notices. Notices to you may be sent to the email address registered with your account or posted on the Platform. Notices to us must be sent to contact@localbizindia.com and, where required, to the registered address above.
Language. These Terms are drafted in English. Any translation is provided for convenience; in case of conflict, the English version prevails.
